Hi All,
Please share your experience. This is quite urgent. My H1B(8+ year) is expiring, and my company is willing to file H1B with Engg manager role. My previous H1B or extension was files for software engineer. My GC(EB2) is filed as Software engineer, with PD as Jan 2006.
Questions
1) Now is it ok to file H1B with new title? What if H1B gets rejected?
2) How does this title change affect GC? Can the GC be cancelled because the title has changed or H1B gets rejected? The engg manager role is similar to software engneer role, except people responsiblities.
3) If the H1B gets accepted, then is there still a danger to GC? Do they verify GC papers before approving H1B?
Thank you, Raja

Guys,
I have been reading some posts since yesterday. I still haven't been able to get a confirmed clarification.
If I am on H1, and change my status on H4 for lets say 8 months. Then decide to start working again on H1, would I be counted against the cap again?
I have been reading some posts which says if I have been counted against the cap once in last 6 years, I won't be counted again. Does that apply when one changes visa status from H1 to H4, and then back to H1.
Has anybody done this successfully. Can you point to some clarification or law from USCIS itself?

Antis point to polls showing more Americans support the Arizona bill than oppose it. But other polls - including new ones from ImmigrationWorks USA and Immigration Voice, show these same voters also support - by wide margins - comprehensive immigration reform proposals that contain legalization programs. Is this really a contradictory result? Maybe not. Americans want ACTION on immigration reform rather than maintaining the status quo. Action can mean an SB1070 or something on a broader scale - even if it is called "amnesty." Here are slides outlining the ImmigrationWorks poll. Keep an eye on polling of Republican voters who...

Hi,
I am Vijay Vellabati, finished MS in Dec-06 and I got a job in Jul.
I am in my OPT(Optional Practical training). I did not get to file for my H1-B.
Can my company apply for Green card for me right now.
Because I need to keep my status, my OPT expires in Dec-07.
If anyone can get back to me, I would appreciate that.
Thank you.

Yes, green card is for future employment, your employer can apply for your greencard!!
But usually the greencard process takes so long that it is nearly impossible to get it in a year (the time you have in OPT) so the safe bet is to apply h1b otherwise in US-Masters quota if you have one. And take it from there.

I was trying to find out if one can transfer from b1/b2 visa category to H1- B visa within the valid period of stay(i.e before the expiry of the I-94).
Go out of the country and come back in H1 status, provided you have a valid H1-B. (Can go to Canada also). Otherwise, too many hassles. (non-immigrant vs immigrant intent)

I am an EB3 (rest of the world) -
My I485 has a receipt date of 7/24/2007.
The processing date TSC is showing is 7/16/2007.
When my date comes up inside the Processing dates range, will the category be relevant for the approval? I am asking this question because I have a friend that is an EB2 and a receipt date of Sept 2007, and got his GC on December 2007...
If the categories are relevant, how can we monitor the process (the processing dates then become irrelevant)...

The National Foundation for American Policy has put out a number of excellent reports on the state of American immigration and now they have two more. Family Immigration: The Long Wait to Immigrate Family immigration quotas are inadequate and result in separation and long waits for Americans, lawful permanent residents and close family members. Approximately 4 million people are waiting in family immigration backlogs, according to data obtained from the U.S. Department of State and Department of Homeland Security. The wait time for a U.S. citizen petitioning for a brother or sister from the Philippines exceeds 20 years. A U.S....

Law.com reports that the American Bar Association is being pressured to move a conference in Phoenix scheduled for next week after its co-sponsor for the event, the National Legal Aid & Defender Association, announced it was pulling out of the event. Other groups that planned to send representatives, like the City Bar Justice Center in New York, called for the conference location to be moved. A number of speakers at the event have also announced they will not attend. Law.com also reports that Alpha Phi Alpha, the national black fraternity, announced plans to move its annual conference in July from...

American Family Visas are permanent Immigrant Visas, meaning genuine applicants under this category may obtain permanent residency in America if they meet qualifying requirements.
Family migration is based around 2 general categories; one is based on a preference system and the other offers permanent residency regardless of the demand for Immigrant Visas. The latter, the Non-preference Category, is for immediate relatives of American citizens.
Fiancee's of American citizens will need to apply for a temporary non-immigrant K1 Visa if they wish to join their partner in America.

Wondering what the impact will be for 140 processing with the revised bulletin. Mine EB-2 has been pending in TSC for the last 5 months. It's my understanding we cannot use the AC-21 provisions like switching jobs without approved 140.
If 140 processing goes up to a year that would be really bad for new applicants. Atleast they should resume Premium processing. Any thoughts?

Back in 2002, the President signed a law designed to keep immigrant families intact, the Child Status Protection Act (CSPA). The law includes a provision that states that if a child turns 21 years of age before obtaining a green card together with his parents, his petition would "automatically be converted to the appropriate category" and he would be entitled to the "original priority date". What does this mean? Consider the case of Melvin Cuellar de Osorio. His grandmother, a U.S. citizen, submitted a petition to sponsor his family for permanent residence in 1998. Because of long backlogs, Melvin's parents...

If it has been more than 90 days for the EAD renewal application and the EAD is about to expire, what can one do? I know they no longer give walk-in EADs. I have tried to contact them but no positive response. Any help would be appreciated.

Hi,
My attorney missed the RFE deadline for my H1B extension as the RFE was never received even though USCIS sent it. Please let me know your experience if any one missed responding to RFE deadline for H1B extension and what procedures they followed to fix the issue. Please advise.
Thanks,
Ravi

My Wife is on H4/AOS.
Her H4 is going to expire in September and she is planning to travel soon.
She has AP and EAD but never used. I am on H1 and used AC21.
My questions are..
1) Can she go to home country and get her H4 stamped and return on H4?
2) Apply AP and return on AP?
3) Assume...If she returns on AP...and show valid EAD while entering at POE....
But by that time her H4 expires.... In this scenario...do we still need to apply H4 extension after entering US?
4) Who supposed to apply H4? Is it employer or H1 holder can also apply H4?
Thanks for your help
