The current processing time for an I-140 EB2 Appeal for an Advanced Degree Professional is 24 months; for an I-140EB3 Appeal for a Skilled or Professional Worker is 24 months. Yes, this can be done. The H-1 company needs to submit a new I-129 petition requesting a change of status for your brother. Alternatively, your brother can leave the US, apply for an H-1 visa and re-enter in H status.

Its a mundane process. Do not worry or get over excited about it. Your application is just getting a free ride from Texas to Nebraska. Just wish it a safe journey:-)

as far as I understand it, you will be eligible for AC21 in feb. As long a they do not withdraw your 140 you should be ok. Just switch to a different employer and invoke AC21 in feb. Disclaimer: consult an attorney to confirm.

The normal process I heard is that they start at the 70 day to complete it by the 90th day. So you can expect it from 70th day onwards.

For how long you are waiting for GC and for how long you are willing to wait more for GC?
A lot of people have been for a long time. That is the reason IV has formed to eliminate/minimize the wait.
I don't think any one is willing to wait here !!!!

How much time does it take for 485 to get approved with a visa number available. I applied for 485 after my i-140 was approved. Does the priority date have anything to do with processing for 485?

My cousin who came here on H4, found a company that sponsored her H1-b and she was working as a consultant to a big firm. She had to return to home country last year, and she had to get her papers stamped - which was denied.
she continues to work for the same firm from India. She has a house in the US, that she has put on market, and continues to pay the mortgage. Does she realistically have a chance of returning to the US on H1-B?

I want to request everyone - Members and non member ( they will have to sign up at IV) to please update the all the information for the tracker.
Please update any communication that you may have had with USCIS, like RFE, Reciept notice and any other information.
This information can be very useful to IV for generating reports and talk to the officials confidently with data and looking at the trends .. say for RFEs or something else.
Anonymous users please sign in at IV using any ID , and update all the information related to any communication in the past with USCIS.
I would request everyone , that after updating the profile please post a comment to this thread , so that this floats on the home page for a couple of days, so that more and more users can read it and update their profiles

I am on H1B all these days and now my company wants me to mandatory move to EAD. (no option here). I also had my H1B approved for an other 3 years.
1) Is it a good idea to move on EAD now.
2)Its been close to 6 years on my H1 but I still have 8 months left on the initial 6 years. Can i use the left out period on H1B later.
3)Now that I am on EAD, if i need to move my employer, can I invoke the AC21. if yes what should I do... do i just need to resign at the current place and join at the company b.
4)Can my employer revoke the I140, considering that its already been more than 180days since approved.
Note: I have my 485 pending and 140 approved in April 2008 and I am a July 2007 filer with a priority date of June 24th 2007.

I am a strong supporter of Comprehensive Immigraton Reform (CIR). I have been on both sides of the fence. In the late 1970s and early 1980s, I was an attorney for the Immigration and Naturalization Service.
