More H-1Bs and More high skilled foreigners will not only revive the economy, they will create more jobs for the currently unemployed Americans.
Let those who spread the false rumors that high-skilled foreigners "will work for less" that their lies are only hurting their own children and grand children. Whereas more high-skilled immigrants will ensure those children and grandchildren of nativists and of all Americans can also have an American dream, just like their parents did. If nativists were to kick us out then the new generations can kiss the American dream goodbye.

Hi All,
I am on L1A visa which is valid till December 30 2010. My 7 year limit on L1A will end with that date. I have applied for Labor on October 20, 2009 with another employer (not with the one who has sponsored L1A). Since I applied for Labor (PERM) can I apply for new H1B petition now based on the receipt number ? Please advice. Thanks in advance for your help.

I have a question regarding AC21 portibility. I got my EAD in Oct 12th 2007. In the labor(used a pre-approved labor), the base pay mentioned is 48K and I was getting paid 55K from my current employer(A) who filed my green card.
I am getting another job in company (B) in the same field. The salary offer is better but is very high than mentioned in my labor. The new salary is around 85K.
1) Will the high salary will cause any issue with green card process if I take AC21 and use my EAD. Anyone had this kind of experience with the salary difference.
2) How do I know my new job is in the same or similar category as defined by USCIS.
3) Is AC21 is safe to take.

Hello,
1. I last entered US in Dec 2009 on H1B valid till Sep 2012.
2. Was laid off, changed my status to F1.
3. Got new employer, transferred my H1B to the new employer, got approval notice with no I 94 attached. My H1B visa stamping is valid till Sep 2012.
What are my options? Do I need new H1B visa stamping? Or just re enter with new I94?

My friend filed I-140 and I-485 concurrently on 8/6/2007. His lawyer just got a rejection letter (not RFE) from INS due to the I-140 filing fee problem: The expected filing fee is $475 and the check in his filed package is $425. It is a $50 different. Does anybody have the similar situation as my friend ? And
how do you guys handle this prolem ? Any suggestion is appreciated.

In preparation to file I485, we just had medical tests and the doctor checked the box " Applicant does not meet immunization requirements" in my son's report citing the reason insufficient dates.
What is the impact of this ? How this can be remediated ? Any suggestions by those who experienced similar situation would be greatly appreciated.

The USCIS website stated on April 20th that they are still accepting applications as the H1 quota of 65000+ 20000(Masters) was not full.

I guess that is also H1B as H1B for non-profit organizations does not fall under yearly quota .they can get H1B anytime , so no need to wait til Oct.

I am working on H1B visa as full time employee (Business Analyst) for a global manufacturing company. After going throughforums I understand that as consulting employees need client letters, similarly full time employees need in house project documentation for visa stamping. I work in IT department of my company where we maintain applications and provide production support and there is no specific project that I am working on. Should full time employees must have in house project documentation for visa stamping? Will I have any problem if I tell VO that I provide production support and am not working on a specific 1 project?

Is it possible to obtain a Greencard from L1B status? If yes, how long does this process typically take? My understanding is it is possible and definitely easier/shorter than being on H1?
Yes, it is possible to obtain a Green card from L1B. However, you will have to undergo the Labor certification process (PERM application). Time wise there will not be a difference whether you apply under H1-B or L1B. It is only foreign nationals who are managers and executives on L1A status are eligible to apply for the green card without the labor certification.

I want to request everyone - Members and non member ( they will have to sign up at IV) to please update the all the information for the tracker.
Please update any communication that you may have had with USCIS, like RFE, Reciept notice and any other information.
This information can be very useful to IV for generating reports and talk to the officials confidently with data and looking at the trends .. say for RFEs or something else.
Anonymous users please sign in at IV using any ID , and update all the information related to any communication in the past with USCIS.

Hi,
I am on the 8th year of my H1B. I have an approved I140. There is a chance that I may have to leave my current job, and there will be a gap before I obtain another job. Two questions:
1. Can I stay in the US just on an approved I140 and no H1B?
2. I know I can get my H1b transferred. Can I instead leave my current job, be on I140 for some time, and apply for a new H1B for the new job, still continuing the 8th year?

My husband got into the country through the Mariel port
immigration from Cuba in 1980 hes been in this country since then. Im a
US citizen we are legally married. The problem was that 20 years ago
when he was about to get is residency he got incarcerated and the
process was can canceled by the immigration office. About 4 or 5 years
ago he lost all of his papers he has no ID or any document that proves
his legal status. Which I think is not going to be any help anyways
because he never got a Visa number he did got a an alien number but of course he doesnt remember it so basically he is in paper limbo, because you need an ID to get an ID. He recently got his Cuban passport but now we find out that is basically useless. I been trying to get someone to please explain to me in this case what can we do? It seems that because he is Cuban and enter the country as a refugee almost 30 years ago no one can tell me for sure what will be the procedure in his case.
Please if there anybody that can help I would really appreciated

Hi, my BIL was on H1, and lost his job, then he moved on to EAD, which he hadnt because my sister was on h4, then my sister got a job and went to home country to get it stamped as advised by their lawyer. Now her visa got rejected, maybe bec the company she got the job in is not very big. Anyway now for her to come back, my BIL has been advised to go back on H1.
My questions are:
1) How safe is it to go from EAD to H1
2) Is it true that if you are on EAD and then if you try to go back to H1 the chances of it getting rejected are high? And if your H1 gets rejected then there are chances that your EAD will also get rejected?
3) How long does it take to move from EAD to H1
Any insights/suggestions/advises on the above would be greatly appreciated.

I have the new h1b approval valid till from october 5 2007 to october 4 2008.
