This year a record number of 15 million foreign applicants entered (http://www.cbsnews.com/stories/2010/11/22/national/main7078653.shtml) the green card lottery system which only hands out 50,000 green cards each year.
The lottery program was established by the State Department back in 1990. Participation in the lottery has grown steadily as people in the developing word have gained increasing access to the internet. The month long enrollment period ended on November 3. Many people apply year after year since there is no limit on the number of times you can apply. The only rule is that only 7% of the winning applicants may come from any one country.

Hi,
I received RFE on my 485 for I94 copy. My situation is below
I travelled to Tijuana, Mexico from San Diego by road to request
for new I94 at the US Port of Entry at San Ysidro, Tijuana as my old I94
was issued only until PP expiry date but since i already had a valid I94 on H1B notice, The officer didn't issue a new white I94 card even though i requested for one. Also, The officer took my earlier old white I94 card, so i don't have one with me now though i have a copy
of it. Also USCIS is asking for a detailed explanation as to why new I94 was not issued at POE. please advise on how to respond to this RFE

Do you think the lottery will take place for 2010 year H-1B filing?
zero I think...
H1 filing follows the general employment scene, and with the current employment levels, and the relatively low levels of recovery being seen so far, the chance of a lottery seems almost nil....
H1s for last year ran out just last week, why would 65k cases show up within a day just 3 months later?
However I dont expect it to last till December 2010 like it did this year. Employment is going to slowly improve going forward, TARP H1 hiring restrictons dont apply to many banks...

I had visited US for 6months in 2005 on H1B visa and currently my H1B is expired( Expired in Jun 2007). Now, I am in US on H4 visa. Can anyone please let me know is it possible to renew expired H1B now? If so, what is the procedure for the same?

I can tell you from my past dot com bust experience, getting companies to file for GC had become very tough. Getting labor certification cleared was even a bigger challenge. I can say, when economy goes south, immigrant's life gets tougher. Hope for the best, prepare for the worst.

I am on H1B and my wife is in H4 here. She is a nurse and can apply for the AOS before Aug 17 .But she does not have all certificate that makes her AOS approved at this time. We hope that we can obtain the certificate (Visa Screen certificate) by the time the RFE comes. But it is a 50-50 chance only. So what could be the best option for us and consequences of each.
My case (h1B)
1. I also apply for AOS with her so that I can get aGC along with her but do not use the EAD .
2. I apply for the AOS later but before her AOS approved.
My wife case (h4)
1. Apply for the AOS but do not use EAD
2. Apply AOS and use EAD.
Also do you know around when the USCIS issues RFE once the application is recieved?
I really appreciate your advice in this.

Anyone following the cap count would see that H1B numbers have gone down from 45500 to 44400 in one week. Since obviously even if no one submitted an H1B applicn last week, the only way numbers could have gone down is if USCIS denied 1100 applications. Seems like a high number of rejections in one week. My guess is these numbers reflect the the RFE(impossible to reply RFEs) cases that were sent to the premium processing and a few regular processing cases that ran out their time limit and got denied. It will be funny( for the anti immigrants) to see if the Cap count numbers continue to go down and guess by sept 2010, the numbers still available in the quota would be around 60k?!?

The big news is that the masters cap was hit as of December 24th. I had been predicting since last summer that this 20,000 quota would be hit in the last week of the year and the pace of usage stayed extremely consistent. The general quota has 7,700 visas of 65,000 remaining as of December 31st and the rolling four week average is now running at just over 1500. We have seen a modest up tick in usage since the masters cap ran out, but not as much as might be expected. It looks like we've got five to six...

In what could be a new incarnation of the successful bipartisan �Gang of 14,� Minority Whip Trent Lott (R-Miss.) hosted a meeting this week with a handful of the Senate�s most notable compromisers to figure out how to unclog the gridlock that has slowed the chamber�s progress this year.
About half a dozen moderate and independent-minded Republicans and at least one Democrat � Sen. Ben Nelson (Neb.) � participated in the Members-only huddle, which was held quietly in Lott�s Capitol office Tuesday morning. Afterward, few Senators offered much detail, but several said there�s a feeling among them that the narrowly divided chamber no longer can operate at an impasse and they want to find ways to avoid the growing number of filibusters sidelining Senate legislation this year.
�We�re seeing if there�s a way to bring some people together to bring some more comity to this place,� Nelson said.
Lott declined to discuss the meeting or its goals, saying only: �I think I ought not say anything. Others are going to say too much, so I am not going to say anything.�
According to other Senators, however, the discussion focused on how the deal-minded group could help avert the growing number of standoffs in trying to clear bills through the Senate this Congress. Most particularly, Senators said they vetted ways to work through upcoming fights on such issues as appropriations bills and stalled judicial nominations such as that of Leslie Southwick, Lott�s home-state pick for the 5th U.S. Circuit Court of Appeals.
Southwick narrowly cleared the Judiciary Committee last summer but has yet to come up for full Senate consideration. The White House and Republican Senators have been trying to corral 60 votes to advance his confirmation, but are still shy of meeting that mark against powerful Democratic opposition.
�It�s about creating a better environment to get things done for the country,� said Sen. Lindsey Graham (R-S.C.), who participated in the meeting. �We need to get back to being a deliberative body.�
�We�re going to see if we can work beyond the logjam,� said Sen. Olympia Snowe (R-Maine), who also was there and described it as the �beginning of a process.�
Graham, Nelson and Snowe were members of the previous Congress� bipartisan Gang of 14, a group of seven Democrats and seven Republicans who assembled in the face of a bitter partisan Senate standoff over movement of President Bush�s judicial nominees. The group brokered a historic deal to allow for votes on certain stalled Bush picks in exchange for keeping the minority�s option to use the filibuster intact.
That group didn�t formally involve Lott as one of its members, but the then-rank-and-file Mississippi Senator was a primary force behind the scenes leading to its creation. Lott stepped away after the gang officially formed.
Nelson wouldn�t say this week whether Tuesday�s meeting was a step toward
re-creating a similar bipartisan coalition, calling the Gang of 14 �unique.� But the Nebraska Democrat did suggest there are clear parallels in terms of the two groups� goals.
�It�s just a conversation at this point,� Nelson said. �We�re trying to see if there�s an interest in building support for moving legislation and to avoid having as many cloture votes as we�ve had and moving legislation along.�
So far this year, the Democratic majority has called to invoke cloture, a lengthy procedural roadblock that has markedly slowed down Senate action on a whole host of bills, some 56 times. Democrats have argued they are forced to do so against an intransigent 49-seat GOP minority, while Republicans have insisted it shows that Democrats are trying to ram through legislation without their input.
Although not all showed up, sources indicated that about 10 Senators were asked to take part in Tuesday�s meeting. In addition to Lott, Nelson, Graham and Snowe, GOP Sens. Susan Collins (Maine), Bob Corker (Tenn.), John Warner (Va.), John McCain (Ariz.), Gordon Smith (Ore.) and Norm Coleman (Minn.) were invitees.
Although not in attendance Tuesday, Coleman said discussions abound among rank-and-file Senators about how to �fix things� and break some of the legislative stalemate. He added that it�s not a surprise that Lott � one of the Senate�s most notorious deal-makers � would lead the charge.

Just Received a copy of my ETA 7089 from my HR. I learned that my Labor Cert may not have been properly filed.

H6 - Is experience required in the job offered required for the JOB?
is NO
H14 - Specific Skills or other requirements says:
Qualifications include:
1) Five years of experience in Web Development ... and so on
H14 and H6 Contradict themselves...
My HR is dumb and the attorney had made mistakes for simple H1b filings in the past..
Any help/suggestions will be appreciated!
