I am in a unique situation. I have filed for my H1B through company A and pretty recently got a 3 year extension too. I also have an approved Labor and I-140 through them. This May the company had an asset only aquisition and is now operating under a new name and Employee ID. Since we are all open to file our I-485 I contacted my immigration lawyer and explained the company reorganization. At first the lawyer was claiming that we should file an Amended I-140 due to the reorg. My company lawyer informed my Immigration Lawyer that the new company has not taken over the liabilities of the old company, it only took over the assets. Now my immigration lawyer claims that I will have to transfer my H1B to the new company and move forward with my original I-485 application and then port after 180 days. I wanted to get a second opinion from someone on this board.

I am looking for work. Not too concerned with how much money I make, but would like some money for jobs. I can program some mildly advanced AS, and I can draw some Flash vector art, as well as pixel art. I have Macromedia Freehand, so if you need pictures traced for use in Flash, I can do it, save it as a .eps and email it to you. If anyone has any work for me, please post or PM me.

My daughter is on F1 visa since she turned 22 years. She has her AOS (employment based dependent on me) pending. I-140 cleared and I -485 filed before she turned 22 years. She has also received her EAD and AP based on pending AOS.
We are planning to go to Canada and she want to use AP for reentering USA. My question is:
1) Once she enter USA using AP what happens to her F-1 status? Can she continue her F-1 status?
Appreciate guidance from Gurus/ Lawyers.

I entered usa in H4 visa in july 2008 , while my H1 was applied from india in april 2008 ,and H1 got approved . now my employer is forcing me to do COS(H4 to H1) or go to india for stamping because he can't hold my H1 in a approved state so long . due to current market condition and so many rejections i am afraid to go for COS . He is asking $2800 only for regular COS processing !!!! thats too high , he is going to file fresh H1 petition I129 along with COS I539 .
my question is
instead of applying fresh H1 petition i.e I129 , since my H1 is already in approved state so can i apply only I539 for changing my status ?

You need your passport or Picture ID/DL to verify your name and DOB.

As most of you know we formed a focus group to work on the 'Country Cap issue'.
We have a letter ready to be sent out the the lawmakers to lift the Cap - may be temporarily- I would request you guys to spend 5 minutes and 42 cents and send it out to your senators and congressmen/Congresswomen�.If 50 people from California can send this letter to 'Congresswoman Zoe Logfren', I'm sure it will some some difference...

I am one of those unfortunate guys who missed the July 2007 boat.
Is there any chance of the priority date getting current again (soon) like in July 2007 even for a month?

While filing I-485 do I have to choose which I-140 and PD to be used. Need your advise which one should I use,
1. I-140 approved with details as: PERM LC (EB3, PD Dec 2006).
2. I-140 pending (just filed) with details regular LC (EB3, PD Nov 2004).
Choices are:
A. Just file 485 with 140 with earlier PD(option2 ), and let both 140 and 485 continue.
B. File 485 with approved 140
C. Convert pending 140 into premium, and file 485. Is the extra $1000 justified for this?

I think immigration firms will stay out of it for the sake of the law suit. However companies like MS, oracle, and hospitals maybe should join.

I have a similar question. My EB-3 PD is August 2005 (I-140 was approved but I never filed the I-485 because of retrogression). Few months back I found out that the employer had withdrawn/revoked the I-140. Now my employer is getting ready to file my EB-2 I-140 and my question is: Can we retain/interfile the priority date from 2005? I know the answer is yes but I am looking for examples where any fellow member was able to successfully do so. Thanks!
