My spouse's priority date is late nov 2008 and we are still waiting. Has anyone seen any approvals of audited PERM filed in nov 2008. Please share your experience.
i assume DOL is processing nov as of this month.
Any analysis/predictions?

I am getting ready to file for my 485. I have a problem, and I am not sure how to go about it --
My wife's birth certificate has her name listed differently than it is. The birth certificate has a temporary/pet name. Is there anything I can do now, in next 14 days, before I can file for 485? Will any kind of affidavit help?
Appreciate all your suggestions.

Most of the time, I write about problems immigrants have with US immigration officials, but this week I heard from an American in Valencia, Spain who had her purse snatched right after arriving. Gone were her credit cards, cash, and, most importantly, her passport. My friend H1B is expiring this month end but she has valid EAD wth her.When we are planning to use EAD from H1B,what is the procedure for that?Do we have to send any forms to INS for this change of status??
Just you need to fillout a new I-9 form and hand over it (along with copy of EAD) to your H1B employer ,also mention moving to EAD..thats it..

Hey guys, can you please post your experience on how long did it take for the labor to get approved under the PERM process? I am planning to upgrade my GC application from EB3 to EB2 and am looking for this information to plan out my next steps.

I have heard in the past from a lawyer that when in H1B status the filing of Green Card must be done and labor certification approved before the 5th anniversary of H1B status. In other words, one cannot start the process for a Green Card in the 6th year of H1B status.
Is this correct? Or is the lawyer being overly cautious?
If such a rule does exist can you please point me to the exact regulation?

Who is the best immigration attorney out there to deal with a cross-chargeability case? (Need to claim cross-chargeability based on Spouse's citizenship on an already filed I-485 case).
Any first hand experiences with attorneys like Rajeev Khanna, Murthy, Ron Gotcher etc?? Or is there anyone better (in terms of paying proper attention while filing & being reachable in case of any RFEs etc.,) out there?

2 (a) is only if you have an approved I-140. In your case write "Concurrent filing of I-140/I-485 based on NIW"

Tried to post in another, old thread - no response for several days, so decided to create a new one.
I asked my employer to create sub-account for me at http://www.plc.doleta.gov so I could check my PERM case status without polling them. The employer got back to me and said "looked into the site and I couldn�t find the way to create user account to view your case only".
They dont mind making sub-account for me, same way they do for attorneys and paralegals, but they dont want me to see their other pending cases or any information, unrelated to my case. So, my question is: is there a way to create sub-account, which would allow seeing my own case only?

You may be eligible. CIS usually requires 4 years of university-level education for a degree, or 3 years experience for every one year missing from a 4-year degree. An educational evaluator could say for certain if you have the equivalent of a US bachelor's degree.

Robert Creamer has an interesting analysis of how the ruling in Arizona could affect the Democrats' prospects in November. Many pundits are assuming that Republicans benefit. But Creamer makes a point I've said here many times. The only voters who switch their votes on the immigration issue are Hispanics. Anti-immigrants NEVER vote for the Democrats anyway. They almost always have a host of issues that they care about and in most cases the GOP is the better fit for those voters. So Democrats who try and pander to the Tea Party types are wasting their time.

I don't think I've ever seen a discount, Canon triple rebates, or any low prices in general over here...
Your prices are lower *and* you get rebates - not that I want the Kodak dSLR, but it's still not fair. :)
