:)I was cited under open container law in state of NJ newark pennstation.will this impact on my immigration status . I am a july 2007 filer waiting for the GC and working on EAD

Based on the lessons and experience gained from last Saturday demonstration in San Jose, we are organizing another protest this Saturday. A newly established yahoo group is working actively on preparing for this week's event.

I am on H1-B. I filed I-485, I-131 and I-765 in August 2007 under EB3 (ROW). I got married in Sept 2007 but my wife is still in home country due to J-1 2 year HRR. Her 2 years are up in Jan 15, 2008 and she plans to join me on H4.
1. Does my company or I need to do anything for her to apply for a visa at the consulate? Does she take a copy of my H1-B approval marriage certificate and that's it?
2. When she comes the US at the end of January we plan on filing I-485 for her based on my application pending. Can she file for AP and EAD at the same time? Would she be able to work on EAD if it gets approved?
3. I got a letter in the mail today that I have to appear for biometrics on Nov 07, 2007. Does it mean that after my biometrics are taken my GC could get approved right away, even though EB3-ROW is no longer current?
4. After my I-485 has been pending for 180 days, does it mean I could take a similar job anywhere?

I am in US in L1 Blanket visa and is expiring on November 26th 2009.
I am planning to go back to India for renewal.

Hi,
My I-485 was filed in June'2007 in Nebraska service centre since my company is based in Michigan. I live in PA.
I am filing my EAD now but according to the latest instructions for EAD, the filing centre should be decided based on where you live. So for PA, the filing centre listed is Texas.
My question is should I file in Texas based on where I live or in Nebraska where my I-485 case was filed. The USCIS case tracker also says that my case is at Nebraska.

I just received my initial EAD and it is only valid for 1 year. My priority date is October 2006. Shouldn�t I have received an EAD valid for 2 years?

is your case eb2 or eb3? what nationality are you from? if you are eb2 india, then it could potentially mean that you might get GC within one year...

I am not sure if I am posting it in the right forum. So please excuse me if not. My cousin have some immigration case going on in San antonia, Texas court. She lives in California. Her court date is on 30th July in texas. I need help to find a good immigration lawyer for her. Could you guys please suggest me immgration lawyer (if possible Indian) there, so that I could contact asap. TIA.

I have changed from h1 to f1 in 2002, but did not apply through the mail in status change process, just took my I20 and got it stamped in a Consulate outside US (Mexico in my case).
So not sure, how the mail in status change would affect you if you directly show up in a US Consulate. It is probably best to ask a Lawyer.

Hi- I'm e-filing my I-131 and it is asking where my I-485 is pending? How do I find this information? The cases status online does not give away this information.

EAC - Vermont Service Center
SRC - Texas Service Center
WAC - California Service Center
LIN - Nebraska Service Center

If her H-4 has not expired she can file now for a change of status from H-4 to H-1, as per the last action rule, her petition filed now will override the earlier request for H-4 extension. If she does not have an unexpired H-4 she can file for COS based on the pending H-4 extension request by including the receipt.

My I485 has a receipt date of 7/24/2007.
The processing date TSC is showing is 7/16/2007.
When my date comes up inside the Processing dates range, will the category be relevant for the approval? I am asking this question because I have a friend that is an EB2 and a receipt date of Sept 2007, and got his GC on December 2007...
If the categories are relevant, how can we monitor the process (the processing dates then become irrelevant)...

I am stuck out side of US for my name check for last 9 months when I applied for H-1. I have approved I 140. is there any way I can file my I 1485 and Advance parole or any thing to get back into US.
Some one has told me that I can use consular processing but have no idea about that.
Please help me and let me know what are possible options for me to return to US.

You cannot apply for I-485 unless I-140 is approved as EB1 is purely based on I-140 not labor.
