Hi,
I apologize if I am asking a repeat question.
I received my green card a few months ago but my family haven't received their's yet. As a result they are still using EAD and/or Advance Parole documents. I am considering a job change and in that context I have two questions:
1. Are there any gotchas that I should be aware of - given that my family's cases haven't been approved yet.
2. If I do change jobs, can I apply for EAD and Advance Parole documents for my family on my own? Meaning, without going through the employer.

Parents frequently come to the US but I may need to travel to Pakistan for emergencies or perhaps to get married. Should I go to Pakistan or Canada for H-1b stamping or is too risky with the lengthy administrative processing (221-g)?

My case: NIW 140 approved, PD 2006/10, now 485 pending. But I am leaving USA to another country for a permanent job. I am not sure if I should withdraw the 485 or just convert it to CP.
1. Will it be possible for me to get the green card thru CP if I get interviewed and can't show any ties with USA? Can I enter USA during CP? I hope to have green card in case I don't like my new job and come back to US someday. But I may just cancel 485 in order to affect the least my future visiting visa application. Suggestions?
2. I am on H1 now, but H1 will expire 1 month before I leave USA. So I understand that I can stay legally on AOS for the one month, true? Do I need to do anything for switching from H1 to AOS? Again, I need to come back to USA for business/visiting, so I want to do everything right not to harm my future non-immigrant visa application.

Please provide a ready reckoner on AC21. Like the basics. This would help lot of people trying to switch employers including me. I know there were memos written by Yates and other lawyers. Your real experience on this matter always counts and helps people.

I was working with employer �B� (from Jun 09 to Jun 10)
I was previously also working with employer �A� (which is now my present employer) from Jul 08 to Mar 09,
My H1 Transfer from employer �B� to �A� has been filed in last Jun 10 but it is in Process now.
Now my present project is over, I have got a project with employer �C�
My Questions:
1. Can I join the employer �C� by filing another H1 transfer? as of now still my H1 Transfer (employer �B� to employer �A�) is in process.
2. I have also got another project with my ex employer �B�, I can see the I797 petition of the employer �B� is still showing a status of approved in the USCIS state, it has not been reoked. Can I rejoin the ex employer �B� without filing any new H1 Transfer ( from employer �A� to employer �B�).

Hello All,
I will be appearing for L1 individual visa extension in chennai in a few days from now.
One the questions that would be asked by the VO would be "where and who do you work for". The second part is easy since i work for the petitioning employer rendering my services for their client. However for the first part of the question what appropriate answer can be given?
Can i mention the client name location in US since that is where i currently work although i am controlled by the petitioning employer. I would not be working from the petitioning employer work location in US. I believe the L1 Visa reform act of June 2005, tells that you can work from offsite location provided you are controlled/managed by petitioner.
Please advise as it would help me in responding with correct answer. Thanks.

Can you get AP when you are out of status anytime during your stay in USA, if you get AP can you travel outside USA and enter back using it.

Yes you should furnish this info. One of the forms asks for details of previous marriages which you should provide. I think you will also need to provide your divorce decree. Providing the information does not impact your application one way or the other.

My current AP expires on July 30, 2008. I am planning to apply for renewal in Jan or Feb 2008, which is 6 months prior to expiration. I understand that nowadays it takes more than 3 months for approval.
In case of emergency, Can I travel to India with my current AP while AP renewal petition is pending?.
